1. Acceptance of Terms

By accessing or using the AvtarX platform ("the Application"), whether via browser, local file, or any other means, you ("User") agree unconditionally to these Terms. If you do not agree, you must discontinue use immediately. Your continued use of the Application constitutes ongoing acceptance.

AvtarX uses a local-first interface with hosted inference routing. Full creative and legal responsibility rests with you, the User.

2. Nature of AI-Generated Content

AvtarX uses browser-side orchestration with hosted model inference to interpret prompts and produce image output. This process is inherently non-deterministic. Output may deviate from your description, contain visual anomalies, or produce abstracted results with complex input. These are properties of generative systems, not defects. AsuraX accepts zero liability for the quality, fidelity, or aesthetic coherence of any output.

3. User Responsibilities

AsuraX does not actively monitor or moderate user-generated content. Users bear sole legal and ethical responsibility for all content generated. You agree not to use AvtarX to generate content that is illegal, defamatory, harassing, trademark-infringing in a commercial context without fair use justification, or that depicts minors inappropriately.

4. Copyright & Ownership

AsuraX asserts no copyright claim over generated output. All image.png files produced are considered the creative work of the User. You receive a perpetual, royalty-free license for personal and commercial use. This license does not protect you from infringing third-party IP if your prompt explicitly replicates protected works — that responsibility remains with you.

5. Privacy & Data Handling

AvtarX is privacy-first and accountless. The Application contains no analytics scripts, tracking pixels, remote logging, or telemetry. No personally identifiable information is collected directly by AsuraX. Avatar generation requests are sent to the configured hosted inference endpoint and responses are returned to your browser session. The source code is fully inspectable via browser developer tools.

6. Caching & IndexedDB

The optional "Cache: ON/OFF" toggle enables writing your most recent prompt, size setting, and generated image reference to browser IndexedDB under the avtarx_ namespace. This data is stored on your device only and is subject to browser same-origin isolation. When caching is OFF (the default), cached keys are removed. Users on shared devices must verify the cache is off before each session. AsuraX accepts no liability for privacy exposure from locally cached data.

7. Availability & Warranty Disclaimer

The Application is provided "AS IS" and "AS AVAILABLE" without any warranty, express or implied, including implied warranties of merchantability or fitness for a particular purpose. AsuraX does not guarantee continuity of service and reserves the right to modify, suspend, or permanently terminate the Application at any time without advance notice.

8. Limitations of Liability

To the maximum extent permitted by law, AsuraX, its creator Adhyansh Verma, and contributors shall not be liable for any indirect, incidental, or consequential damages arising from use of the Application or reliance on generated output. The Application is provided at no charge; aggregate liability to any User shall not exceed zero. You agree to indemnify AsuraX from any claims arising from your use of generated content or violation of these Terms.

9. UI Features & Accessibility (RGB Toggle)

The "RGB Mode" toggle applies rapid continuous chromatic animation to interface elements. Users with photosensitive conditions, light-triggered migraines, or ocular sensitivities are strongly advised against activating this feature. Enabling it constitutes explicit acknowledgment of these risks and a release of AsuraX from associated liability. The default static neon cyan interface is designed for broad accessibility.

10. Modifications to Terms

AsuraX reserves the right to revise these Terms at any time. Updates are reflected in the "Last updated" date above. Because no contact data is collected, users are responsible for periodically reviewing this page. Continued use of the Application after any revision constitutes acceptance of the updated Terms. If any provision is found invalid, the remaining Terms continue in full force.
